Privacy Policy
Last updated: October 13, 2026
Spark 360 Agency LLC ("Spark 360", "we", "us") is a marketing, web design and AI agency. This policy explains what information we collect when you visit our website, talk to our AI advisors Alfred and Sofía, book a call or hire us, why we collect it, who we share it with, and the choices and rights you have. We wrote it in plain language so you know exactly how we work.
01Who this policy applies to
It covers visitors to spark360agency.com, people who chat with our AI advisors or contact us by email, phone, text or WhatsApp, and our clients. If we build a website or system for your business, your own customers' data is covered by your privacy policy, not this one — we handle it only on your behalf and following your instructions.
02Information we collect
- Contact and business details you give us: name, email, phone, business name, industry, city, website and social media profiles.
- Project information: your goals, budget, timeline, the services you're interested in, and the answers you give in our forms or on a call.
- Conversations: the messages you exchange with Alfred or Sofía (text or voice), and emails, texts or WhatsApp messages you send us.
- Client materials: logos, photos, videos, texts, product and price lists, and any account access you choose to give us (for example, your Google Business Profile, social media or domain) so we can deliver your service.
- Payment details: we receive confirmation of your payment, the amount and the last digits of your card. Your full card number is entered directly with our payment processor — we never see or store it.
- Website usage: pages and sections visited, time on page, device and browser type, and a random visitor ID saved in your browser.
03How we use it
- To answer your questions and recommend the right service and price for your business.
- To prepare proposals, process payments and send receipts and invoices.
- To deliver what you hired us for: build and maintain your website, manage your content, Google Maps profile and campaigns, and set up your AI assistant.
- To contact you about your project — including reminders about upcoming payments you agreed to.
- To keep our website secure, prevent fraud and spam, and improve our services and our AI advisors.
- To meet legal, tax and accounting obligations.
04Our AI advisors, Alfred and Sofía
- Alfred (English) and Sofía (Spanish) are AI assistants, not people. They answer questions, explain our services and prices, and can send you a payment link when you decide to move forward.
- Your conversation is saved so our team can review it, follow up personally and make sure your proposal is accurate. Erick or a member of our team may read it.
- If you use voice, your browser turns your speech into text, and the advisor's spoken reply is generated as audio. We don't keep recordings of your voice.
- AI can make mistakes. The final price and scope are always the ones shown on your order and payment page.
- Please don't share passwords, full card numbers, health information or other sensitive data in the chat.
05Messages and calls
We contact you by email, phone, text or WhatsApp about the request you made or the services you hired. We only send promotional messages if you agreed to receive them. You can unsubscribe from emails using the link in the message, reply STOP to any text, or simply ask us — and we'll stop. We do not record calls without telling you first and getting your consent.
06Who we share it with
We share information only with the service providers we need to run our business, and only what each one needs:
- Payment processing (such as Stripe, and Klarna if you choose to pay in installments).
- Scheduling (Calendly) and video calls (Zoom).
- Website fonts (Google Fonts), which receives your IP address when the page loads so it can deliver the font.
- Email and business communication tools (Google Workspace / Gmail, WhatsApp by Meta).
- Secure cloud hosting and database providers that run our website and systems.
- AI providers that generate our advisors' replies and voices.
- Platforms you ask us to work on for you, such as Google, Meta (Facebook and Instagram) or your domain provider.
- Authorities or professional advisors (lawyers, accountants) when the law requires it or to protect our rights.
07We don't sell your information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We don't use or disclose sensitive personal information for any purpose other than providing our services.
08Account access you give us
When a project requires access to your accounts, we use it only to do the agreed work, limit it to the team members who need it, and never use it for anything else. When the project ends or you cancel a monthly plan, we recommend that you remove our access or change your passwords — we'll help you do it.
09Cookies and browser storage
We use a small amount of browser storage to remember your language, sound preference and chat, to keep our website working, and — for our own visitor statistics — a random visitor ID. We don't use advertising cookies or ad pixels, and we don't track you across other websites. If your browser sends a Global Privacy Control (GPC) or "Do Not Track" signal, we turn our visitor statistics off automatically, and you can turn them off yourself at any time on our Cookie Policy page (spark360agency.com/cookies), which lists everything we store.
10How long we keep it
- Inquiries and conversations that don't become a project: up to 24 months, then deleted.
- Client records, contracts and payment records: while you're a client and up to 7 years afterwards, as required for tax and accounting purposes.
- Client materials and account access: for as long as we provide the service, and removed after it ends unless you ask us to keep them.
11Security
We use reputable providers, encrypted connections (HTTPS), restricted team access and secure payment processing. No system is 100% secure, but we work to protect your information and will notify you if a breach affects your data, as required by law.
12Your California privacy rights
To make a request, contact us at erick.spark360@gmail.com · (650) 520-7307. We'll confirm your identity with information we already have, and respond within 45 days. You can also name an authorized agent to make the request for you.
- Know what personal information we collect, use and share about you, and get a copy of it.
- Ask us to correct inaccurate information or delete your information.
- Opt out of the sale or sharing of your information (we don't do either).
- Not receive different treatment for using these rights.
13Where your information is processed
Our business and providers are based in the United States. Some of our team members work remotely outside the U.S.; they access client information only as needed to do their work and follow the same privacy rules.
14Children
Our website and services are for businesses and adults 18 and older. We don't knowingly collect information from children.
15Changes to this policy
If we make important changes, we'll update the date at the top and, for active clients, let you know by email.
