Terms of Service
Last updated: October 13, 2026
These terms explain how working with Spark 360 Agency LLC ("Spark 360", "we") works — pricing, payments, timelines and what each side is responsible for — so everything is clear before we start. By using our website or buying our services, you agree to these terms.
01Our services
We provide website design and development, e-commerce, branding, website management and content, paid ads management, AI chatbots and automation, and consulting. The exact scope of your project is the one described in your order, proposal or invoice.
02Prices and quotes
- Prices on our website and from our AI assistants (Alfred in English, Sofía in Spanish) are "starting at" prices and can vary by industry and scope.
- Your final price is the one confirmed in writing (order summary, proposal or invoice) before you pay.
- Third-party costs are separate unless your order says otherwise — for example, ad spend paid to Google/Meta/TikTok or premium domains and apps.
03Payments
- One-time services are paid in full to start. If you prefer, you can pay in 2 payments: 50% to start and the remaining 50% 7 days after the first payment. The second payment is charged automatically to the same payment method on that date — it's shown before you pay and we email you a reminder one day before. By choosing 2 payments you authorize that second charge.
- You can also pay with Klarna, which lets you choose a payment plan and pay over time (typically 3 to 12 months), subject to Klarna's approval. Klarna pays us in full and you pay Klarna according to your plan.
- Monthly services (website plan, Website Management, AI bots, ads management, etc.) are billed every month in advance.
- When monthly services are ordered together with a new website, the first month is paid together with the website; those services start once the website is live, and the next monthly charge is one month after launch.
- No processing fees or surcharges: our prices already include payment processing, so you pay the same price by card, Cash App Pay, Klarna (pay over time), bank transfer or Zelle.
- Zelle: you can also pay the full amount of a one-time service with Zelle to (650) 520-7307. Send us the payment confirmation by WhatsApp to the same number or by email to erick.spark360@gmail.com; once we see the payment in our bank, our team contacts you within 12–24 hours to start. Zelle is for payments in full (2 payments and Klarna are only available through our secure checkout), and some banks limit how much you can send per day — if yours doesn't allow the full amount, you can pay through our checkout instead.
- Some monthly plans (such as Google Maps & Local SEO) can be prepaid for 3 months at a discount. After the prepaid period they continue month to month at the regular monthly price unless you cancel before the next charge.
- When you buy a website (one-time) together with any add-on in the same order, you get $100 off the website, one time. Monthly website plans (Website Subscription) are month-to-month and can't be split into 2 payments or financed with Klarna.
- Late or failed payments may pause work or monthly services until the balance is paid.
04Content for monthly services
- Website Management Essential and Pro, and all Google Maps & Local SEO plans: you provide the photos and videos each week (phone photos are fine). We edit, optimize and upload them. If we don't receive content in a given week, we use what we already have or skip that week's uploads; the monthly price stays the same.
- Website Management Done-For-You: our team schedules one on-site photo & video session per month (about 2 hours) at your business in our service area. Travel outside our service area may have an extra cost, confirmed before booking.
- Google Business Profile: Google requires the business owner to complete the profile verification. We guide you, but we can't control Google's verification times or decisions, and we never guarantee a specific ranking.
05AI assistants for your business
- Monthly AI assistant plans include a set number of messages per month (for example, 1,000). Extra messages are billed at $47 per 500, or you can move to a larger plan (for example, $977/month for 2,500 messages). Your monthly report shows your usage.
- Setup prices are starting prices; connections to calendars, CRMs or other systems can increase the setup price, always confirmed in writing before any extra charge.
06Monthly plans: automatic renewal and cancellation
- Monthly plans renew automatically every month, at the price shown in your order, charged to the payment method you used, until you cancel. The amount, how often you're charged and how to cancel are shown before you pay, and we email you this information after your purchase.
- Plans are month-to-month unless your order says otherwise (ads management has a 3-month minimum).
- Cancel anytime, without calling: email erick.spark360@gmail.com (or reply to any receipt) and write "Cancel". Cancellation takes effect at the end of the period already paid, and there's no cancellation fee.
- If we change the price of your plan, we'll email you at least 7 days before the new price applies, so you can cancel first if you prefer.
07Timelines
- Websites are usually delivered in 7–10 days, or 3–5 days with Rush Delivery.
- Timelines start once we receive your first payment and the content we need (logo, photos, texts, access). Delays in content or feedback move the delivery date.
08Your responsibilities
- Provide accurate information and the content, feedback and approvals needed on time.
- Make sure you have the rights to any logos, photos, text or materials you give us.
- Keep your account access and passwords secure.
09Ownership
- Websites purchased one-time: once paid in full, the final website design and content created for you belong to you.
- Monthly website plan: the website is provided as a service while your plan is active. If you'd like to own it, ask us about converting your plan to a one-time purchase.
- We may show your finished project in our portfolio unless you ask us not to.
10Refunds
Refunds follow our Refund Policy (spark360agency.com/refunds): a full refund before we start your project, 50% after we start but before the first design or concepts are delivered, and no refund once they're delivered (we keep revising within your package). Monthly plans stop future charges when you cancel; partial months aren't refunded. If something isn't right, contact us first — we'll always try to make it right.
11Results
We work hard to grow your business, but results such as sales, leads or search rankings depend on many factors outside our control, so we can't guarantee specific results.
12Our AI assistants (Alfred and Sofía)
Alfred (English) and Sofía (Spanish) are AI assistants. They give information, recommendations and estimates to help you decide, but they can make mistakes. Your final scope and price are always the ones confirmed in writing. Never share passwords or card numbers in the chat — payments are only made through our secure payment links or by Zelle to (650) 520-7307.
13Payment disputes and chargebacks
If something about a charge doesn't look right, contact us first — we'll review it and fix any mistake quickly. If a chargeback is opened for work already delivered or in progress, we may pause the work until it's resolved and share the project records (order, approvals, messages) with the payment processor.
14Third-party platforms
We work with platforms we don't control — for example Google, Meta (Facebook, Instagram, WhatsApp), TikTok, Stripe, Klarna, domain and hosting providers. Their approvals, policies, outages, fees, account suspensions or algorithm changes are outside our control, and their own terms also apply.
15Your content and indemnity
You're responsible for the content, logos, images, prices, claims and information you give us, and for your own products and services. To the extent allowed by law, you agree to defend and hold Spark 360 harmless from claims that arise from that content or from how you use the website and tools we deliver.
16Limitation of liability
To the extent allowed by law, Spark 360's total liability for any claim related to a service is limited to the amount you paid for that service in the previous three months, and Spark 360 is not liable for indirect, incidental or consequential damages, such as lost profits, lost data or business interruption.
17Electronic communications
You agree to receive orders, receipts, notices and agreements electronically (email, text or our website). Paying through our checkout or approving an order or proposal in writing (including by email or message) counts as your signature.
18Accessibility
We want everyone to be able to use our website. If anything is hard to use or read, call or text (650) 520-7307 or email erick.spark360@gmail.com — we'll help you and give you the information in another format.
19Governing law and disputes
These terms are governed by the laws of the State of California, USA. If a disagreement comes up, contact us first and we'll try in good faith to resolve it within 30 days. If we can't, either side may take it to the courts of the State of California, including small claims court.
20Entire agreement
These terms, together with your order, proposal or invoice, are the whole agreement between you and Spark 360; if they differ, your signed proposal or invoice prevails for your project. If any part of these terms can't be enforced, the rest still applies.
21Changes
We may update these terms from time to time. The date at the top shows the latest version; your signed proposal or invoice prevails for your specific project.
